Can I get compensation?

If you are unfairly dismissed, you can make a claim for compensation consisting of a ‘basic award’ and a ‘compensatory award’. The basic award is based on a maximum weekly amount for every year of your employment and based on your age. The amount of the compensatory award takes into account your loss of earnings as a result of losing your job and includes immediate and future losses. If you have been unemployed since your dismissal you must show the Tribunal that you have mitigated your losses (that you have been actively searching for new employment) to avoid a reduction to the compensatory award.

 

For discrimination claims compensation is unlimited. We can advise you on your rights and the likely value of your claim, together with the likelihood of your claim succeeding.

 

However, it may not always make economic sense for you to pursue a claim. If this is likely to be the case, we will advise you as to the best course of action.

 

What will it cost?

Unlike other types of Court disputes, legal costs are normally not recoverable in the Employment Tribunal from the other side in an Employment dispute even if you win your case. That is why we offer a ‘No-win No-fee’ arrangement. This means that if you do not win your case, you will not have to pay our costs. How long will it take?

Most cases will be heard within 12 months of issue, although this could be much longer if your claim is more complex.
