Sacked woman loses at employment tribunal

Employment 02 Feb 2011

Sacked woman loses at employment tribunal A woman who was fired from her job as a playground monitor in a primary school has failed to win her case at an employment tribunal.

Carol Hill was dismissed from Great Tey Primary School in Essex after she informed the parents of a seven-year-old that their daughter had been bullied by other children.

At an earlier hearing to determine if wrongful dismissal had been used, a panel found that the school had employed incorrect procedures to fire her but that she had behaved with "gross misconduct".

However, an employment tribunal this week found that she would not be awarded compensation for her 2009 dismissal, as even if the correct procedures were used to let her go she still would have been fired.

In contrast, another case last year saw a domestic assistant win an unfair dismissal case and a payout. Chelsea resident Maire-Chantal employed Susana Danio over a two year period but unfairly let her go last April, a judge ruled.
