Wrongful dismissal results in £8,000 compensation

Employment 16 Dec 2010

Wrongful dismissal results in £8,000 compensation Wrongful dismissal and discrimination against a man fired by Stagecoach Scotland has resulted in a compensation payout of £7,989.

Paul Smith suffered back pain and was involved in a road accident at work, resulting in him taking large amounts of time off, The Courier Reports.

But a judge claimed wrongful dismissal occurred when his employers decided the refusal of an alternative position within the company constituted a "bad attitude" and the victim was given his notice in 2009.

A Stagecoach spokeswoman claimed the firm is "committed to ensuring the health and well-being of [its] employees", but revealed the company is "disappointed" with the conclusion of the employment tribunal.

Having worked for the transport group since 1995, the victim's unfair dismissal payment may have been increased and his possession of a doctor's note proved Mr Smith was unable to resume his position.

In a recent case of unfair dismissal of a domestic worker, Susana Danio was awarded £7,500 compensation after an employment tribunal judge ruled she had been fired on the basis of malicious gossip and suffered reputation damage.
