Man loses whistle blowing case

Employment 01 Jul 2011

Man loses whistle blowing case A worker who was employed as a warehouse operations manager has lost his whistle blowing case against his former employer.

The Redditch Advertiser reported that Martin Packer, of Stourport, lost his claims for breach of contract and unfair dismissal against Ravensbank Business Park in the town.

Mr Packer claimed he told the firm that a colleague had a criminal conviction as it was in their best interests to know.

However, Pam Hughes, a judge at Birmingham Employment Tribunal, said that the disclosure was made as Mr Packer believed that he could benefit.

Mrs Hughes also said that the company had told Mr Packer that he risked redundancy.

"Mr Packer showed a lack of judgment. It was wholly inappropriate for him to behave the way he did and his compensation claims are dismissed," Mrs Hughes added.

However, a number of workers have been successful in employment tribunal cases this year.

In one such case, Maggie Pattinson was awarded £35,000 for unfair dismissal after she went to a tribunal.
