Legal solicitors help illegitimate children win court ruling

Legal Services 21 Jul 2011

Legal solicitors help illegitimate children win court ruling Legal solicitors have recently convinced a judge the illegitimate children of a duke are entitled to the benefits of his estate.

The judge ruled in the High Court that the UK should not stop the offspring of "invalid" marital unions from receiving inherited wealth.

Mr Justice Floyd said: "It follows that I consider the trustees are entitled under the terms of the settlements to provide for Alexander and Ashley."

As a result of the battle legal solicitors fought on their behalf, the children, who resulted from Duke of Manchester Alexander Montague's second bigamous marriage, will be able to benefit from their father's estate.

The Duke had a bigamous marriage with Wendy Buford in 1993 and the union with Ms Buford produced two children, Alexander and Ashley.

These children have not received maintenance from the trustees of their father's estate in Ireland and England since 2009, when they found out that they were the result of a bigamous marriage.

Alexander Montague, the 13th duke of Manchester, was born in Australia to the 12th duke of Manchester and Mary McClure and is a descendant of several British politicians, as well as a distant relative of Princess Diana.
