£3.5m car accident claim settled out of court

Personal Injury 05 Nov 2010

A car accident claim resulting from a crash that left a woman paralysed has been resolved out of court. A car accident claim that could have resulted in up to £3.5 million personal injury compensation has been closed without recourse to a formal hearing, after the parties settled out of court.

Rachel Davis now has to use a wheelchair after a car driven by her former boyfriend left the road and flipped during a dangerous overtaking manoeuvre.

Her personal injury compensation may be substantial, as the victim's life has been irrevocably changed and she now requires assistance to care for her young child.

The driver was overtaking his friend at high speed when the crash happened and an earlier court hearing ruled the man in this car would be liable for 20 per cent of the motor accident claim, due to his failure to allow safe overtaking.

Judge Lord Brailsford had anticipated three weeks of evidence on the case, but personal injury lawyers reported a deal had been agreed upon by those involved.
