Court throws out personal injury golf case

Golfers 'not obligated to shout fore' A golfer's personal injury claim in the US has been thrown out by a judge in New York.

The Court of Appeals upheld a decision to dismiss the lawsuit brought by a doctor from Long Island against his sporting partner.

In the claim, Dr Azad Anand attempted to sue his friend over a rogue shot that hit him in the eye during a round they were playing in 2002, affecting his vision and as a result, his practice.

However, the Court of Appeals has ruled Dr Anoop Kapoor was not obligated to shout "fore" ahead of his shot.

The court decided such accidents are a "commonly appreciated risk" associated with playing golf and Dr Kapoor's failure to issue a verbal warning did not amount to intentional or reckless conduct on the course.

Meanwhile, the current snow and ice hitting the UK is expected to result in higher volumes of work for claims solicitors, as people seek redress from local councils for falls, Wales on Sunday reported recently.
