Employee wins accident at work claim
Personal Injury 19 Jan 2011

The importance of seeking
accident advice has been highlighted by a recent case in which a man was compensated after being injured in the workplace.
JKL Industrial Services Ltd admitted breaching Regulation 11 of the Provision and Use of Work Equipment Regulations 1998. As a result, it was instructed to pay
accident compensation of £5,000, as well as costs of £2, 534.
The company, of Canalside Close, Goscote was tried by Walsall Magistrates’ Court after an incident on October 28th 2009 in which an employee, who has not been named, received an
accident injury.
During the incident the teenager, who had begun working for the company that day, trapped his hand in machinery and was left with injuries.
"This young man has suffered permanent and debilitating injuries from an incident that should never have happened. JKL Industrial Services did not provide adequate guarding for the power press, failed to maintain the machine properly and failed also to ensure it was thoroughly examined by a competent person," Health and Safety Executive inspector Eve-Marie Edwards said.
In another incident in March 2010, Machine Hire Ltd, a Burnham-based furniture firm, was fined £12,000 after an employee was injured in the workplace.
