Ken Clarke criticises 100% compensation system

The
100% compensation system, whereby personal injury claimants do not pay
accident lawyers' fees out of their settlement, has been criticised by justice secretary Ken Clarke.
He suggested a US-style approach, whereby claims solicitors are paid out of the reparation package, could bring down the costs of the system and make it fairer for employers and organisations at risk of paying out large sums of money.
It had previously been deemed unfair for an individual to cover the costs of personal injury litigation out of a settlement for an accident that was not their fault, but recent changes to
legal services have made some question the sustainability of
100% compensation plans.
Speaking on Radio 4, the Conservative MP implied his viewpoint was upheld by leading figures within the justice system, stating: "A very experienced judge, Sir Rupert Jackson, has come up with some very good recommendations which I find - and the government finds - very attractive."
