Soldiers win helicopter accident claim
Personal Injury 28 Oct 2010

An
accident claim brought by three soldiers has been won, following a fatal helicopter crash in 2007 during which the men suffered life-changing wounds.
Each will be awarded up to £300,000 personal
injury compensation in a case that may be considered as a
work accident or professional negligence.
Christopher Hamilton, John Falconer and Dahrll Duncan were travelling in a Westland Puma with three other individuals who lost their lives when the helicopter crashed near an army training camp in Yorkshire.
The
accident claim should take account of the medical care needed by the victims, as well as loss of wages and the fact all three were forced to leave their posts following the incident.
After an inquiry, it was found the smash happened due to the pilot attempting manoeuvres beyond his capabilities.
Responsibility has been accepted by the Ministry of Defence and calculations will now be made based on the men's personal circumstances to determine the final sum of the personal injury payout.
