Work accident claim upheld by FOS
Personal Injury 14 Oct 2010

A
work accident claim by pipe-fitter Joe Greensmith has been upheld by the Financial Ombudsman Service (FOS), which ordered the victim's insurers to pay personal
injury compensation of £170,000.
Aviva had originally rejected the case as the wounded man failed to fill out his time sheet following the accident, with the FOS stating: "On any fair and reasonable view, Aviva should not be seeking to raise technical points to resist this claim," reports the Post Online.
The
work accident claim should allow Mr Greensmith to live more comfortably, after he suffered minor brain damage and memory loss due to the incident in 2007.
Following a burst pipe the victim needed £30,000 worth of dental work and the personal
injury compensation takes this into account, alongside other costs such as retraining and interest, reveals the Daily Mail.
In a statement the insurer noted it 'respects' the ombudsman's decision and apologised for its handling of the case, claiming to have learned lessons that will be applied to future dealings of a similar nature.
