Brain damaged boy set to receive injury compensation

Personal Injury 12 Apr 2011

Brain damaged boy set to receive injury compensation A boy who was brain damaged at birth is set to receive injury compensation from a Welsh hospital.

Callum Davies, aged eight, will receive the payout from Gwent Healthcare NHS Trust after his birth was delayed at Nevill Hall Hospital in Abergavenny, leaving him with brain damage and dyskinetic cerebral palsy.

The trust, which now belongs to the Aneurin Bevan Health Board, is set to pay him £2.275 for his personal injury and has apologised to his family.

London's High Court also decided that the board will pay for Mr Davies continuing health care each year with tax-free, index-linked payments.

"I am well aware that that the settlement approved by the court is not the complete answer, but what I do hope for the family is that these monies will make life easier," Justice Nicola Davies said.

Furthermore, in another court case this month, injury lawyers won £8 million for a young boy, Nathan Humphries, who was also injured at birth.
