Man keeps compensation from accident claim

Personal Injury 17 Mar 2011

Man keeps compensation from accident claim A man who was involved in a road traffic accident has won the right to keep the compensation that he claimed from his insurer after the company disputed his right to the sum.

A judge decided that Mark Noble should keep the £3.4 million he was awarded for his motorbike accident claim from his insurer Direct Line.

The company had hired private investigators to film Mr Nobel, of Wareham, Dorset, with a covert camera as they wanted to prove that he had not told the truth about the severity of his injuries. The insurance company was informed by a neighbour that they had spotted Mr Noble walking unaided.

However, a judge ruled that he began to walk again through his own determination.

Mr Justice Field said: "He did not dishonestly conceal from the court or the expert witnesses his then true state of disability, or dishonestly emphasise his disability."

The accident occurred in 2003 when the motorbike Mr Noble was riding on was involved in a crash with another vehicle.

In another road traffic accident case, last year Rachel Davis was awarded an undisclosed out of court settlement after a car she was being driven in by her former partner flipped over.
