Probate 'to avoid empty dwelling orders'
Probate & Estate Administration 17 Sep 2010
Probate solicitors can help families avoid empty dwelling orders when a loved one passes away, after it emerged will-writing is just the first step to ensure belongings are passed on as the owner would wish.
The Echo reports a home in Southend has fallen into disorder after the testament of the deceased owner was not taken to probate.
Neighbours Rosie and Cliff Stone say the house has been empty for 15 years, stating: "The longer it falls into disrepair [the more] our homes are devalued by it. I wish the council would take it on, rather than give us reasons why it hasn't."
Unoccupied residences can be made subject to an empty dwelling order, whereby the local authorities assume control of a property and often rent it out as low-cost housing.
Proper
probate administration can avoid this situation, which might be distressing for family members unsure of how to deal with a vacated home.
