Man loses wills and probate battle
Probate & Estate Administration 12 Aug 2011

A man has recently lost a
wills and probate battle over his deceased partner's property portfolio.
Torquil Mackenzie Buist was involved in a legal dispute with the executors of the will made by his partner, Timothy Hadcock-McKay, claiming that Mr Hadcock-McKay had intended his entire estate to go to him.
Since his late partner, a presenter on Time To Get Your House In Order, died, Mr Mackenzie Buist claims that the executors of his will have left his property portfolios either be sold or repossessed and added that he had given labour and cash to the portfolio.
Despite this, Sir Robin Jacob at London's Court of Appeal said that Mr Mackenzie Buist could not proceed any further with his case and should look for an out-of-court settlement with the executors of the will.
Sir Robin said: "The question should not come before this court, because it has no prospect of success."
According to the executor of the will, they also had to look after the interests of the other will beneficiaries, who are several of Mr Hadcock-McKay's relatives.
This case highlights the importance of carefully choosing
executors of wills and also informing them of their role to avoid any confusion after a person's passing.
