Probate question posed to expert
Probate & Estate Administration 26 May 2011

One individual has written to the Financial Times about a probate matter, saying that they wish to leave half of the home they own with their husband to their two children when they die.
The person wrote to the news source saying that they want half the value of their home to be ring fenced for their children.
In addition, they would like their partner to stay in the house for a few years but for it eventually be sold and the proceeds divided.
They asked how they should write this into their will.
Matthew Woods, a partner at a solicitors, said that this person must work out just how the home is jointly owned with their partner.
Mr Woods recommended that if it is a joint tenancy the reader should sign a document to dissolve this, so that when they
make a will their share of the home will go to their children.
In addition, the importance of making this document was emphasised by solicitor Simon Leighton, who told the Guardian that it was crucial for people with dependents.
