Woman avoids jail after wills and probate abuse
Probate & Estate Administration 11 Jul 2011

A woman has recently avoided being handed a jail sentence after appearing in court over
wills and probate abuse.
The Wisbech Standard reported that Donna Smith was given a suspended sentence after she claimed over £15,000 in benefits despite her father
making a will that left her more than £50,000.
She was sentenced to three months imprisonment, suspended for 12 months, by Peterborough magistrates.
Ms Smith was also given a three month curfew, during which she will have to remain in her house between 7pm and 7am.
In addition, magistrates instructed her to pay £200 in costs.
“The benefits system exists to help those in need. It is seriously undermined by people who deliberately cheat and lie about their circumstances,“ councillor Kit Owe, Fenland District Council’s portfolio holder responsible for benefits, said.
Last month another lady, Andrea Thomas, of Roxeth, was lucky to avoid prison after not informing the authorities after receiving an inheritance while claiming income and housing support, the Harrow Observer reported.
