Executor of will receives pension payback demand
Will writing 13 Dec 2010

A woman acting as executor of will for her mother was shocked to receive a demand for repayment of a mistakenly granted pension 11 years after the error had been made.
Writing to the Daily Mail, the aggrieved reveals despite telling Aviva the recipient of the pension had died in 1999, the firm continued sending it to his window for more than a decade until her death this year.
Her daughter, the appointed executor of will, informed the company of her passing, at which time it demanded reimbursement of the £473 mistakenly credited to the elderly woman's account.
Appointing a professional executor might help avoid such problems, as the experienced legal services providers will be aware of the eventualities that must be considered in the difficult time after a loved one dies.
In an unusual case, an executor of estate was recently accused of conspiring to conceal his brother's death, working with the deceased's girlfriend to send text messages from the dead man's phone and convince family members he was still alive.
