Co-op Legal Services' Lead Family Law Solicitor comments on "a fairer end to relationships" consultation

“Over the last 50 years, we’ve seen significant social change, particularly when it comes to relationships. Marriage rates have more than halved since the early 1970s, while the number of cohabiting couples has grown significantly, yet the law has failed to keep pace with this change.

“If implemented, these proposals would represent the most significant reforms to family law in a generation and would recognise the reality of modern relationships while providing greater financial certainty when a relationship ends.

“Although any new legal framework for cohabiting couples would remain distinct from rights available to married couples and civil partners, it could provide vital safeguards for financially vulnerable partners.

“Crucially, the proposals could also help to ensure that survivors of domestic abuse are better placed to access financial security and independence at the end of a cohabitation, regardless of marital status.

“In addition, with pre-nuptial and post-nuptial agreements becoming increasingly common, the proposal to make them legally-binding is also an important development. With more couples entering marriage with property, businesses and other assets, this would ensure greater certainty as to how these agreements will be treated, providing couples with peace of mind.

“These proposals are a welcome step forward and would better reflect modern relationships. However, we would encourage couples to seek legal advice to protect their interests, including considering cohabitation agreements and appropriate financial agreements.”
